1. Introduction
Jetty Rideshare Inc. d/b/a JettyON ("JettyON," "we," "us," or "our") provides a technology ride hailing platform that enables users to request, schedule, and pay for group transportation of 6–14 passengers in premium vehicles (the "Services"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and JettyON. (JettyON.com)By accessing or using the Services, you agree to be bound by these Terms and any policies referenced herein, including our Privacy Policy.If you do not agree to these Terms, do not access or use the Services.
2. Definitions“Account” – the user profile created through the JettyON mobile application or web portal.
“Operator” – an independent transportation provider or fleet partner that offers rides through the JettyON platform.
“Ride” – any transportation service booked via JettyON.
“Customer” – the individual or entity that books and pays for a Ride.
3. Acceptance of Terms
You affirm that you are at least 18 years old and have the legal capacity to enter into these Terms. Where you book on behalf of a company or group, you represent that you have authority to bind that entity.
4. Eligibility & Account Registration
You must create an Account and maintain accurate, complete, and up‑to‑date information, including a valid payment method. Failure to do so may result in suspension or termination of your Account. 5. The JettyON Marketplace5.1 Booking Process
Customers request a Ride by specifying pick‑up and drop‑off locations, date, time, passenger count, and any ancillary services (e.g., trailer for luggage). JettyON will display a real‑time or quoted price before confirmation. Once you confirm, a contract is formed between you and the Operator, with JettyON acting only as the disclosed agent and payment facilitator.JettyON is not responsible for confirmation e‑mails or notifications that are lost, filtered, or undelivered.
5.2 Pricing & Fees
Prices include base fare, mileage, applicable taxes, tolls, and platform fees. Additional charges (e.g., excess cleaning, overtime, damage) may be assessed after trip completion.
5.3 Cancellations & Refunds30+ days before pick‑up: Full refund of all amounts paid.
3–29 days before pick‑up: 50 % refund.
<3 days before pick‑up or no‑show: No refund.
All refunds are processed to the original payment method. JettyON reserves the right to cancel Rides that violate capacity limits, safety rules, or payment terms.
6. User Conduct & Safety
JettyON enforces a zero‑tolerance policy for alcohol or drug use by drivers. If you suspect impairment, you must end the trip immediately via the app and contact support. Passengers must:Wear seatbelts where available.
Not exceed the vehicle’s legal capacity.
Refrain from smoking, vaping, or illegal activity during the Ride.
Failure to comply may result in trip termination without refund and potential account suspension.
7. Operator Obligations
Operators are independent contractors and are solely responsible for:Maintaining required commercial insurance ($5 M combined single limit).
Ensuring drivers hold appropriate licenses and pass background checks.
Providing vehicles in safe, clean, and road‑worthy condition.
8. Payment Terms
All charges are due at the time of booking unless otherwise specified in a written confirmation. Deposits apply first to any outstanding balance. Service commencement is contingent on full payment. 9. Intellectual Property
All content, trademarks, and software associated with JettyON are owned by Jetty Rideshare Inc. or its licensors. You may not copy, modify, or distribute any part of the Services without prior written consent.
10. Disclaimers
The Services are provided “as is” and “as available.” JettyON disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. JettyON does not guarantee the availability, quality, or safety of any Ride.
11. Limitation of Liability
To the maximum extent permitted by law, JettyON shall not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits or personal injury, arising out of or related to these Terms or the use of the Services, even if advised of the possibility of such damages. JettyON’s aggregate liability shall not exceed the greater of (a) $500 or (b) the amount you paid for the Ride giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless JettyON, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising out of your breach of these Terms, misuse of the Services, or violation of any law or third‑party right.
13. Dispute Resolution & Arbitration
Any dispute shall first be addressed through good‑faith negotiations. If unresolved, disputes will be submitted to binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association in San Francisco, California. Class‑action waivers apply.
14. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict‑of‑laws principles.
15. Modifications to Terms
JettyON may modify these Terms at any time. Material changes will be notified via e‑mail or in‑app notice at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance.
